1. Scope

These terms of use apply to the use of the mobile app “VYC Sahitya”, provided by Vinayaki-Yoga & Coaching GbR (hereinafter “Vinayaki-Yoga & Coaching”):

The content comes from Vinayaki-Yoga & Coaching and its licensors – in particular from Anne Böhme (freelance yoga teacher, “Vinayaki-Yoga”), whose course content is presented in the app.

By using the app, you agree to these terms of use.

2. Not a medical product

The VYC Sahitya app is a digital wellness offering. It is not a medical device and does not replace medical advice, diagnosis or medical treatment.

The content contained in the app – including breathing exercises, hydration recommendations and accompanying notes – serves to generally support a healthy lifestyle in the spirit of yoga. It does not constitute a therapeutic measure and is not suitable for diagnosing, treating or curing illnesses.

If you suffer from an illness or take medication, please consult your doctor before using the app.

3. Notes on statements of effect

Some content in the app refers to effects attributed to yoga practices in the handed-down tradition. These notes are to be understood exclusively in the context of the yoga tradition and do not constitute medical statements.

Examples of traditional attributions that may be mentioned in the app:

• In the yoga tradition, alternate-nostril breathing (Anuloma Viloma) is attributed a calming effect on the nervous system and support for breath awareness. Traditionally it is also practised to promote general well-being.
• In the yoga tradition, Kapalabhati is described as a cleansing breathing technique attributed an activating and energising effect.

These traditions are no substitute for medical advice and have not been clinically substantiated within the meaning of the German Act on Advertising in the Health Care System (HWG) or comparable regulations. Vinayaki-Yoga & Coaching does not adopt these statements as advertising claims.

4. Health suitability and contraindications

Before using the app, you are responsible for checking whether the exercises it contains are suitable for you. If in doubt, please seek medical or therapeutic advice.

Kapalabhati

Kapalabhati is an intensive breathing technique that is not suitable for certain groups of people. Please do not practise Kapalabhati if any of the following applies to you:

• Pregnancy
• High blood pressure (hypertension)
• Heart conditions or cardiac arrhythmia
• Epilepsy or a history of seizures
• Recent abdominal surgery or hernias
• Acute inflammation in the abdominal or chest area
• Dizziness or circulatory problems

Anuloma Viloma (alternate-nostril breathing)

Anuloma Viloma is considered a gentle breathing technique. In the case of serious conditions of the heart, lungs or nervous system, it is nevertheless recommended to seek medical advice before use.

General note

Stop an exercise immediately if you experience dizziness, shortness of breath, pain or other complaints. If complaints persist, contact medical professionals.

5. Use at your own responsibility

Use of the app is voluntary and at your own responsibility. Vinayaki-Yoga & Coaching accepts no liability for damage arising from improper, contraindicated or excessive use of the app.

You yourself are responsible for:

• checking your health suitability before use
• observing the contraindications stated in the app and in these terms of use
• stopping an exercise in the event of physical discomfort
• consulting medical professionals in the event of health questions

6. Passphrase and data loss

The app encrypts all locally stored data with a device-bound key. For transferring data to a new device, an individual recovery passphrase is generated, which you can view in the app settings under “Data & security”.

Important note: Vinayaki-Yoga & Coaching never has access to your data or your passphrase at any time. If the passphrase is lost, recovery of the encrypted data is not possible. Neither Vinayaki-Yoga & Coaching nor third parties can decrypt the data or provide a replacement passphrase.

Therefore, keep your passphrase in a safe place – for example in your device's password manager.

7. Licence to use

By providing the app, Vinayaki-Yoga & Coaching grants you a simple, non-transferable, non-exclusive licence for personal, non-commercial use of the app on your own device.

It is not permitted to:

• decompile, disassemble or otherwise reverse-engineer the app
• copy or modify the app or parts of it, create derivative works or resell it
• use the app for commercial purposes or make it available to third parties for a fee
• circumvent or manipulate the app's security mechanisms

All rights not expressly granted remain reserved. No exclusive rights are transferred; no sublicences are granted.

8. Copyright, AI content and reservation of rights

All content of the app – including texts, graphics, illustrations, sounds, exercise instructions, design elements and the app structure – is protected by copyright and/or ancillary rights.

Note on AI-assisted content: individual graphics, illustrations or other content of the app were created entirely or partly using artificial intelligence. Vinayaki-Yoga & Coaching grants usage rights only to the extent that corresponding rights actually exist; no warranty is given for protectability or complete freedom from third-party claims.

In the event of a breach of these terms of use, the granted licence to use expires automatically. Any further use must cease immediately; further rights and claims remain reserved.

9. Availability and updates

Vinayaki-Yoga & Coaching strives for reliable operation of the app but cannot guarantee continuous availability. There is no entitlement to:

• permanent operation or permanent availability of the app
• specific features or content in future versions
• compatibility with future operating-system versions
• support or bug fixing within a specific period

Updates may change, add or remove features. Using an updated app version constitutes agreement to the terms of use applicable at that time.

10. Limitation of liability

Vinayaki-Yoga & Coaching is not liable for:

• health impairments arising from the use of the app or the practice of the exercises it contains
• data loss due to uninstalling the app, changing devices or losing the recovery passphrase
• functional interruptions or limitations due to operating-system updates or device compatibility
• damage arising from passing on the recovery passphrase to third parties
• damage caused by unauthorised third-party access to your device

The limitation of liability does not apply to damage based on grossly negligent or intentional conduct by Vinayaki-Yoga & Coaching, nor to damage resulting from injury to life, body or health.

11. Changes to these terms of use

Vinayaki-Yoga & Coaching reserves the right to amend these terms of use as needed – in particular when introducing new app features (e.g. community features or an account system). Changes will be announced in the app.

12. Applicable law

The law of the Federal Republic of Germany applies. To the extent legally permissible, the place of performance and jurisdiction is Lauenburg (Elbe), Germany.
